New norms of the Customs Code of the Eurasian Economic Union (EC EAEU)

On January 1, 2018, the Customs Code of the EAEU came into force. The new document is designed to provide a unified customs regulation on the territory of the Eurasian Economic Union (EAEU), simplify the passage of customs formalities and create more comfortable conditions for participants in foreign economic activity. Thus, the Customs Code of the EAEU provides for the possibility of minimizing the participation of officials: all decisions, from the registration of a customs declaration to the release of goods, can be made automatically by the information system, without the participation of an inspector.

The term for the release of goods by the new code has been significantly reduced, and instead of the previously established one working day, customs must release the goods within four hours after the registration of the declaration. The Customs Code of the EAEU also provides for the following innovations:

the possibility of filing a declaration for goods without submitting documents confirming the information declared in it, which, in turn, can be requested by the information system if the risk profile is triggered;
the possibility of making changes to the declaration before the release of the goods, if by this time the documents have not been requested from the declarant, the declarant has not been informed about the inspection or the appointment of an examination;
the possibility of obtaining a preliminary decision on the application of methods for determining the customs value;
improvement of the institution of an authorized economic operator;
the opportunity for any participant in foreign economic activity to take advantage of the deferral of payment of import customs duties with the payment of interest for a period not exceeding one month. A deferment may also be granted for up to six months without payment of interest in cases established by national law.

New norms of customs legal relations established by federal law

On August 3, 2018, Federal Law No. 289-FZ “On Customs Regulation in the Russian Federation and on Amendments to Certain Legislative Acts of the Russian Federation” was adopted. It establishes the features of customs regulation in Russia in accordance with the reference norms of the Customs Code of the EAEU. Meanwhile, Federal Law No. 311-FZ of November 27, 2010 “On Customs Regulation in the Russian Federation” will not cease to have effect completely, and some of its provisions will continue to be in effect for a certain period of time. For example, the provisions on an authorized economic operator will apply to legal entities that have received this status in accordance with the former Customs Code of the Customs Union.

The provisions of the new law are designed to improve customs administration and simplify customs operations. The priority is interaction with customs authorities using electronic technologies. For example, it is possible to apply to the customs authority through the Unified Portal of State and Municipal Services. This innovation makes it possible to obtain preliminary decisions on the application of methods for determining the customs value of goods, as well as on the origin and classification of goods.

Procedure for conducting customs value control

On March 27, 2018, the board of the Eurasian Economic Commission (EEC) adopted Decision No. 42 “On the specifics of conducting customs control of the customs value of goods imported into the customs territory of the Eurasian Economic Union”.

The regulation on the specifics of conducting customs control of the cost of goods imported into the customs territory of the EAEU includes:

the right of customs to use information comparable with information about imported goods and received from state or trade representations of the EAEU Member States and from organizations, including professional associations, transport, insurance companies, suppliers, manufacturers of imported, homogeneous, identical goods;
signs of unreliable determination of the customs value, in particular, the identification of a lower price of imported goods compared to the price of the components from which the imported goods are made, the presence of a relationship between the seller and the buyer, combined with a lower price of imported goods compared to the price of identical or similar goods established between independent parties to the transaction;
criteria when the circumstances named as signs of an unreliable determination of the customs value are not considered as such: if the goods are imported under a foreign economic agreement, in accordance with which identical goods were previously imported under unchanged transaction conditions (price of goods, terms of delivery).
On May 22, 2018, the EEC Board adopted Decision No. 83 “On the calculation of additional charges when determining the customs value of goods”. The document clarifies the procedure for including additional costs incurred by the buyer in the customs value of imported goods.

Goods and resources subject to smuggling

On October 22, 2018, the Russian government made changes to the list of strategically important goods and resources. In the list of objects, the illegal movement of which across the customs border of the EAEU or the state border of the Russian Federation with the member states of the EAEU entails criminal liability under Art. 226.1 of the Criminal Code of the Russian Federation, included:

articles made of precious metals;
articles made of precious stones and natural pearls;
wrist and pocket watches, as well as other items intended to be worn on oneself or with oneself, including stopwatches with a case made of precious metal or metal clad with precious metal;
watch cases made of precious metals;
watch straps, ribbons and bracelets made of precious metals;
ores and concentrates of precious metals.
